Data Policy

Astro Visual asks customers to supply at various times personal data when placing an order, such as name and address, credit-card information, and E-mail address. We use this data only for the purpose of filling an order, or communicating with the customer or supplier about the status of an order.

We will release personally identifiable information to third parties and organisations when we believe it is appropriate for us to do so in order to comply with the law or to protect against fraud. We will also release such information to cooperate with law enforcement or other governmental investigations, protect the legal rights of us and our users, or when we believe it is needed for fraud protection and/or credit risk reduction.

Except for the circumstances set forth in the previous paragraph, we will not knowingly distribute customer information to be used in mailing lists, surveys, or any other purpose other than what is required to perform our services.

What information do we collect? How do we use it?

When ordering from any of our partner sites, Astro Visual must collect the purchaser's name, email address, mailing address, phone number, credit card number, and expiration date. This allows us to process and fulfill orders and provide notification of the order status.

How does Astro Visual protect customer information?

Customers who buy through the Astro Visual system are shopping on a secure server, which encrypts all of the customer's personal information including name, address and credit card number. Encryption ensures that no one can access or use personal information in an unauthorized manner.

Astro Visual has made an investment in protecting our clients' and customers' information utilizing the following technologies:

SSL Secure encryption

Our SSL certificates have the highest possible browser recognition available. Our SSL certificate is accepted by 99% of browsers, with a strong 128/256 Bit Encryption.

Eway gateway

We use a company called eWay located in Australia as our merchant gateway portal for all our e Commerce needs.

Service Delivery Agreement

Domain Name / Hosting

Astro Visual is committed to providing a reliable, high-quality network to support its customers. Providing you with consistent access to your data is a high priority for Astro Visual. We only have our own servers as a service to our clients as it is not our primary service.

Astro Visual will provided you with your domain name registration with 48 hours of receiving your completed documentation and payment. At this time we can provide you with your hosting account details within 24 hours of your domain name being approved.

If you require a standard hosting account, ( no domain name registration) your hosting account will be provided within 24 hours of the completion of the documents and payment, as long as, you the client have provided Astro Visual with full documentation supporting your domain. If you require Astro Visual to change DNS settings for you this will take a further 48 hours to propagate, to point to the correct server.

Web Design

Delivery of our web design services will vary depending on requirements, but Astro Visual can provide you with a timeline to work within to get you up and running as efficiently and quickly as possible.

Usage Policy

Web Design / Hosting

Customers will be held responsible for any activity and content in their respective web sites. All material published in a web site is considered the responsibility of the web site owner. Astro Visual only provide hosting to clients that we develop websites for, this is to reduce the risk of security breach causing downtime. 

Scripts

Any scripts that overload server/ bandwidth is not prohibited and will be removed at Astro Visual discretion, including closure of the web site until the problem is rectified. Continued overload of server/ bandwidth will mean breach of contract and permanent closure of the web site in question.

Bulk Email

The use of services and/or resources for the purpose of sending unsolicited advertising to those who do not have existing business relationships with it's users. Similarly, sites that are referenced in unsolicited email.

Copyright Material / Law

Publication of private information or copyright material without the consent or permission of the person(s) concerned is illegal. Publication content that violates any laws, ordinances, regulations, or assists any other individual(s) to violate any laws, ordinances, regulations, pertaining to any relevant issue whether that be web based or otherwise.

• You may not cause Infringement of Intellectual property rights.
• You may not cause Defamation of Character.
• Publication of content that may considered harmful.
• Publication of any other material that may abuse or break existing laws, or publish anything condoning illegal activities.

Pornography

Any pornographic or malicious content should not be included and will result in the request to have it removed immediately. Failure to do so could result in deletion (permanent or temporary) of your web site. This includes sites that may infer sexual content, display inappropriate nudity, or link to adult content elsewhere.

Copyright

All images on this website are copyrighted. Any copying, usage and/or distribution is strictly prohibited.

Refusal of Service

Web Design/ Hosting/ Domain Names

• We reserve the right to terminate any account (without refund or any financial responsibility to the client) found to be in violation of any item in this policy.
• We reserve the right to withhold any payment made prior to termination of a site.
• We reserve the right to refuse, cancel or suspend services at our discretion.
• We reserve the right to revise these policies when it deems appropriate.
• Non-enforcement of the policies does not constitute our consent.
• All abuses and/or violations of the policies will be investigated promptly upon our advisement of such.

Disclaimer

Astro Visual and any of it's employees, proprietors or directors, will not be responsible for any damages your business may suffer. Astro Visual makes no warranties of any kind, expressed or implied for services we provide. Astro Visual disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays. Non-deliveries, wrong delivery, and any and all service interruptions caused by parties Astro Visual engages to provide the services in question.

Astro Visual furthermore expects that it's customers who provide Internet services to others will fully comply with all applicable laws concerning the privacy of online communications. A customer's failure to comply with those laws will violate this policy.

Finally, Astro Visual wishes to emphasize that in accepting services, customers indemnify Astro Visual for the violation of any law or Astro Visual policy, that results in loss to Astro Visual or the bringing of any claim against Astro Visual and any of it's employees, proprietors or directors. This means that if Astro Visual or any of it's employees, proprietors or directors are sued because of activities of the customer that violate any law, or this policy, the customer will pay any damages awarded against Astro Visual and any of it's employees, proprietors or directors, plus costs and reasonable attorney's fees.

Refund Policy

Web Design/ Hosting/ Domain names

Refund in First 30 Days

If you are not completely satisfied with our Web hosting services, and you notify Astro Visual in writing or by email within the first 30 days of your contract that you wish to cancel, you will be given a full refund of the contract amount. It can take up to 30 days after cancellation of your contract to receive your refund. If you have not received your refund after 30 days, please send an e-mail to Astro Visual.

This policy does not apply to any additional services such as, but not limited to, overages, disk space, e-mail accounts, domain name registration, and Web design services.

Refund Policy for Renewals

Charges for the renewal of Web hosting contracts will be refunded if written notification (either via e-mail message or fax transmission) is received no later than the seventh day following the renewal date. This seven day grace period applies to all Astro Visual Web hosting plans. Note that refunds will not be granted if your written notification is received after the grace period.

Your e-mail notification to us must be sent from the contact e-mail address that we have on file for your account. Likewise, if you fax your notification to us, your fax must be on letterhead.

Domain Registration

If domain name registration is associated with the account, upon the cancellation of the Web hosting product, the account will be downgraded to Domain Name Registration Only.

Domain name registration fees are not refundable.

Requests to Cancel After Renewal Date

You must notify Astro Visual before or within seven days of the Renewal Date on your contract if you wish to cancel an account. Astro Visual does not offer prorated refunds for cancellation requests submitted after seven days of the renewal date.

Your e-mail notification to us must be sent from the contact e-mail address that we have on file for your account. Likewise, if you fax your notification to us, your fax must be on letterhead.

General

No Transfer of Funds Between Accounts

Astro Visual does not transfer funds from one account to another for any reason.

Contact and Billing Information

It is your responsibility to keep valid contact and billing information on your account. Astro Visual will continue to send information regarding your account in accordance with the contact information you have provided in your Control Panel.

Balance Due

Please be advised that the cancellation of an account does not release you from financial responsibility. If your account has a past due balance and you are not eligible for a refund, the Astro Visual Accounting department will continue collection efforts.

• Maintenance,  includes fixes of bugs, and any other errors not previously identified

• Warranty does not apply if website failures are caused by the customer making their own changes
• The warranty does not allow for additions and changes to a website, only bug fixes
• The lifetime warranty applies as long as customer remains hosted with us, if website is moved  to another provider, the warranty is terminated
• Warranty does not apply to out of the box software, eg joomla
